The Securities Commission of Zimbabwe is a statutory body established in terms of the Securities Act (Chapter24:25). Its main mandate is the protection of investors in the capital markets, through effective regulation of the players that include exchanges, securities dealers and firms, investment advisors, transfer secretaries and custodians.

Currently, one piece of subsidiary legislation exists to effect the proper implementation of the Act, being the Securities (Registration, Licensing and Corporate Governance) Rules, S.I.100/2010. In an endeavor to enhance capital markets regulation the Commission received technical support from the World Bank arm First Initiative, to put together a raft of securities rules. The drafts that are in place now need to adopt and conform to the drafting style and format consistent with other subordinate Zimbabwean legislation, while adhering to best practice.

Interested legal practitioners/ firms are invited to express their interest in undertaking this nationally crucial project. Only suitably qualified legal experts with demonstrable experience in drafting legislation will be considered. The eligibility criterion includes;

Specific professional experience

  • Active legislation drafting skills which are required for creating new legislation.
  • Technical expertise regarding the structure and format of legislation, proper use of special and transitional clauses and correct terminology and definitions.
  • Substantive expertise relating to harmonization and compliance issues (such as the relationship with and effect upon existing legislation, to comply with national and international best practice).
  • Legislation interpretation skills required for reviewing, analysing, assessing and applying legislation.
  • Drafting acumen, an acute mind and orderliness in the formulation of thoughts, the ability to pay meticulous attention to detail and to work accurately under pressure.
  • A deep understanding of the existing securities laws and other legislation with a bearing on securities in general.

Qualifications

  • An LLB degree or equivalent.
  • At least 5 years of legislative drafting experience
  • Applicants must provide copies of qualifications and reference letters or similar documents proving the veracity of their profiles.
  • Knowledge of capital markets and securities is a distinct advantage.
